Sérgio Moro: There, as they say, the remedy is excessive and kills the patient.
Sérgio Moro: Today, under the Constitution, in art. 53, §2, a criminal action brought against a holder of a legislative mandate may be impeded after the complaint is received before the respective House, which can make a deliberative judgment as to whether that action has political motivations or not.
This is a decision that has been interpreted affirmatively: the House has to deliberate in order to be able to suspend.
Sérgio Moro: In the past, a criminal action could only proceed if the House authorized it.
Sérgio Moro: That change was salutary, because the previous regime brought serious cases of impunity, a feeling of impunity, recalling that famous and unfortunate Federal Deputy who was involved, down in the Amazon, with organized crime and even used a chainsaw to kill and mutilate his victims.
